These Terms and Conditions govern the relationship between House of Forbes Limited and you, the customer or user, and form part of every contract, quotation, order, and transaction. By engaging with our services, purchasing our goods, or using our website, you agree to be bound by these Terms.
1. Definitions
- We, Us, or Our: House of Forbes Limited and its related companies
- You or Customer: Any individual, company, or organisation purchasing or using our goods, services, or website
- Goods: Products or materials supplied by House of Forbes
- Services: Any professional service offered by House of Forbes, including design, project support, or logistics
- Quotation: A formal written price offer issued by House of Forbes
- Project Documents: All plans, designs, and specifications issued by House of Forbes
- Carrier: A third-party freight or delivery company engaged for transportation
- PPSA: Personal Property Securities Act 1999
- Terms: This document, including all conditions of sale, service, and website use
2. General Terms
- These Terms apply to all transactions and prevail over any terms proposed by the customer unless otherwise agreed in writing.
- These Terms may be updated periodically. The version applicable is that which appears on our website at the time of your order.
- No verbal agreement or representation shall override these Terms.
- All monetary values are in New Zealand dollars and exclusive of GST unless stated otherwise.
3. Orders, Alterations, and Restocking
- All orders are subject to acceptance by House of Forbes. A contract is not formed until goods are dispatched or services commence.
- Once an indent order has been confirmed and a deposit paid, it cannot be cancelled, amended, or altered under any circumstances. Indent orders are final.
- Delivery dates are indicative only. While House of Forbes will endeavour to keep you informed of any delay, particularly those caused by international freight or supplier disruption, all delivery timeframes are provided as a guide only and shall not form any part of the contractual agreement.
- If an order is altered after confirmation, or products are changed or cancelled, the Buyer will be charged a restocking fee equal to 25% of the total invoiced price of the affected goods.
- Custom or special orders may not be cancelled or refunded once production has commenced.
4. Pricing and Payment
- Pricing is subject to change. Confirmed pricing will be supplied with your final order confirmation or invoice.
- A 50% deposit is required for custom orders. Balance is payable prior to dispatch.
- Full payment is required before goods are dispatched or services rendered unless agreed credit terms apply.
- Invoices are payable within 7 days unless otherwise agreed. Late payments may incur interest at 15% per month and collection fees.
5. Delivery, Storage and Risk
- Risk passes to the Buyer upon dispatch or collection. Ownership remains with us until full payment is received.
- Deliveries are made by third-party carriers. Delivery timeframes are estimates only and not guaranteed. The deliveries are covered under the New Zealand Carriage of Goods Act 1979.
- Quoted delivery rates are worked out at time of order, if a delivery address changes we will re quote for the new delivery address.
- The House of Forbes offers a standard B2B delivery service/courier service, we endeavour to find the best possible pricing. If your requirement is a delivery direct to your client or a white glove service this will be quoted at different rates at time of conformation of order, please ask our sales staff if you require white glove delivery service.
- It is your responsibility to inspect goods upon receipt. Damage must be reported within 3 days. Supporting photos and full descriptions of damage are required for claims.
- House of Forbes takes no responsability for goods once collected from us or if your own freight company collects, if damage is reported after this please claim through your own freight mover. It is your responsability to inspect goods when collecting from House of Forbes or our 3pl provider.
- Missed deliveries may incur redelivery fees. Difficult site access must be disclosed in advance.
- Goods may be collected from our premises by prior arrangement, provided payment has been received.
- Once goods are made avaliable we will charge storage if goods ahve not been delivered or collected in 7 days.
6. Returns and Faulty Goods
- We do not accept returns for change of mind. Returns are only accepted for faulty or incorrectly supplied goods, with prior approval.
- All returns must be authorised and accompanied by a Return Note.
- Returned goods must be in original condition and packaging.
- If a fault is confirmed, we will repair, replace, or refund at our discretion.
- The Buyer is responsible for return shipping unless the fault lies with House of Forbes. House of Forbes will only collect from our clients, we do not arrange collection from third parties.
7. Services and Project Work
- Services will be provided as per the accepted quotation.
- Any variation must be agreed in writing.
- Delays due to circumstances outside our control, including subcontractor issues, do not constitute a breach.
- You must provide safe access, storage, and timely approvals to avoid delays or additional charges.
8. Intellectual Property
- All concepts, designs, drawings, and intellectual property remain the property of House of Forbes unless otherwise agreed.
- You may not reproduce or use our Project Documents without written consent.
- You are responsible for ensuring that designs or content provided to us do not infringe any third-party rights.
9. Liability
- We exclude all liability for indirect, consequential, or economic losses.
- Our liability in any event is limited to the value of the goods or services provided.
- Where the Consumer Guarantees Act 1993 applies, your rights under that Act are preserved. If you are acquiring goods or services for business purposes, the Act does not apply.
10. Security Interest
- Until full payment is made, we retain ownership of all goods and reserve the right to recover them without notice.
- You grant us a security interest in goods supplied and agree that we may register this interest on the PPSR.
11. Force Majeure
- We are not liable for any failure or delay in performance due to events beyond our control including, but not limited to, natural disasters, strikes, transport issues, or supply chain disruption.
12. Privacy
- Your personal information is collected for order processing, credit checks, marketing, and communication.
- We will not disclose your information without consent except as required by law or for debt collection.
- You have the right to access and correct your personal information.
- Credit card payments are securely processed via ANZ eGate. We do not store card details.
13. Website Use
- By using our website, you agree to not post illegal, offensive, or infringing content.
- We reserve the right to monitor, remove, or moderate website content at our discretion.
- Any unauthorised use of our website or intellectual property is strictly prohibited.
- We do not guarantee website availability and may restrict access at our discretion.
14. Dispute Resolution
- In the event of a dispute, both parties agree to attempt resolution through mediation before pursuing litigation.
15. Governing Law
- These Terms are governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of New Zealand courts.

Furniture Care instructions
Solid wood (oak, ash, fir, teak)
- Dust regularly with a soft, dry cloth
- Clean using a slightly damp cloth only
- Dry immediately — do not allow moisture to sit
- Avoid direct sunlight as direct sunlight, heaters as they can fade stained timber and cause solid timber to crack, direct air conditioning can cause movement in timber due to temperature changes. NOTE Fading and cracking due to direct sunlight or direct airconditioning is not covered under manufacturers warranty.
- Use wax-based furniture polish sparingly if required
- Never use silicone-based cleaning products on timber furniture as this will void your warranty
Leather upholstery
- Wipe with a soft, dry cloth
- Do not use detergents, solvents, or alcohol-based cleaners
- Keep away from heat sources and sunlight
- Natural marks and patina are normal and intentional
Upholstered fabric
- Vacuum regularly using a low‑suction upholstery attachment
- Blot spills immediately — do not rub
- Use only professional upholstery cleaning for stains
- Avoid direct sunlight to prevent fading NOTE Fading direct sunlight or direct airconditioning is not covered under manufacturers warranty.
